Govt blinks, to release Anna Hazare: sources

New Delhi: The United Progressive Alliance (UPA) Government, finding itself increasingly isolated over the arrest and judicial custody of Anna Hazare and his supporters, finally seems to be blinking. Delhi Police sources have told CNN-IBN that Hazare and seven of his supporters, who were arrested and sent to seven days in judicial custody on Tuesday, are likely to be released later in the night.
Delhi Police sources say that they have sent a warrant to Tihar Jail for the release of Hazare and his supporters. Over 15,000 people who have been detained for taking part in protests demanding Hazare's release are also likely to be released.
Sources say that the Government decided to release Hazare and his supporters after coming to the conclusion that keeping him in jail would create unnecessary law and order problem

Earlier, Hazare supporters Kiran Bedi and Shanti Bhushan were released by the Delhi Police on Tuesday evening.
Hazare and some of his supporters were arrested on Tuesday morning just a few hours before he was to launch his fast for a strong anti-corruption legislation.
Hazare was first detained and then arrested with the Government claiming that there was an apprehension of "breach of peace" if he was allowed to undertake his fast demanding that Team Anna's version of the anti-corruption legislation called the Jan Lokpal Bill be introduced in Parliament.
Hazare and seven of his supporters were later sent to seven days in judicial custody and taken to Tihar Jail after he refused to sign a bond undertaking not to violate Section 144 (unlawful assembly) of the Indian Penal Code.
Manish Sisodia, Arvind Kejriwal, Darshak, Radheshyam, Suresh Pathare, Naveen Jaisingh and Dada Phatare were the other Hazare supporters who have been sent to judicial custody. However, former Indian Police Service Officer Kiran Bedi and senior lawyer Shanti Bhushan were released after being kept in preventive detention for several hours.
Hazare and Sisodia have been kept in Jail No. 4 of Tihar Jail where Congress MP and Commonwealth Games scam accused Suresh Kalmadi is also lodged. Kejriwal and others have been sent to Jail No. 1 where DMK leader and former telecom minister A Raja, who is accused of being involved in the 2G spectrum scam, lodged.
He is continuing with his fast inside Tihar Jail with jail authorities saying that he refused to take food that was offered to him at 6:30 PM.
After his arrest Hazare was first taken to the General Officers’ Mess in Civil Lines area of New Delhi but after his supporters reached there in large numbers, Delhi Police whisked him away to an unknown location and later to the Rajouri Garden Police Station in west Delhi, several kilometers away from Mayur Vihar in east Delhi where he was arrested.
Massive protests erupted throughout the country as soon as the news of Hazare's arrest spread with the Opposition, too, coming out in support of his rights to carry out a peaceful protest. Massive protests and candle light marches have been reported from several cities including New Delhi, Mumbai, Lucknow, Chennai, Bangalore, Hyderabad, Patna, Bhubaneshwar, Bhopal, Chandigarh and Ahmedabad.
The Opposition led by the Bharatiya Janata Party (BJP) and the Left Front called the arrest a throwback to the Emergency days and alleged that the Government was out to muzzle the freedom of expression. Opposition leaders said they would launch an agitation both within and outside Parliament and demanded a statement from Prime Minister Manmohan Singh on the issue.
With both houses of Parliament witnessing stormy scenes and the Government finding itself cornered over the arrests, senior minister tried to justify the crackdown claiming that Hazare and his supporters were defying orders.
Union Home Minister Chidambaram said that Hazare and his supporters were detained and then arrested as they tried to defy the orders despite not indulging in violence.
"Delhi Police arrested Anna Hazare and five others after Anna Hazare told police that they would defy law and were proceeding to JP Park. Extensive discussions took place between Delhi Police and civil rights group on the location of the protest. Delhi Police told the organisers to give an undertaking that they would abide by all the conditions. The organisers refused to accept the conditions or give an undertaking," said Home Minister P Chidambaram.
Chidambaram said Hazare was arrested under Sections 107 and 151 of the Criminal Procedure Code because Delhi Police felt that he could commit a cognizable offence.
Team Anna hit back at the Government calling the arrests undemocratic and called for protest across the country.
Hazare supporter and senior lawyer Prashant Bhushan appealed to the people and government officials to come in large numbers in support of the anti-corruption movement. He called upon all government officials to take one day casual leave on Wednesday and join the anti-corruption movement.
Calling the UPA Government just like the British government, Bhushan said that many people have been detained all over the country.
"Anna was scheduled to undertake his fast from JP Park today. He had announced that he will reach Rajghat at 8 AM and then go to JP park. He was detained at 7:30 AM this morning. The police didn't tell him why he was arrested, not only him but his supporters including Arvind Kejriwal, Kiran Bedi and Manish Sisodia. We have heard that more than 2500 people have been detained in Delhi. Anna Hazare has started his fast from 10 AM today. It's a fundamental right of any citizen of the country to hold a peaceful protest. We had already said that we will not cause any inconvenience but still Section 144 was imposed," said Bhushan.
The National Human Rights Commission (NHRC) has also a report within two weeks on the crackdown on Hazare's agitation from Union Home Secretary RK Singh and the Delhi Police Commissioner BK Gupta.
Coming close on the heels of the police crackdown on Baba Ramdev and his supporters, the action against Hazare is unlikely to give much breathing space to the Government which is finding itself in a corner over allegations of massive corruption under its regime.

Ayodhya: Kanchi seer to talk with leaders

Reiterating his oft-repeated stand that the Ayodhya issue cannot be resolved legally, Kanchi seer Jayendra Saraswathi Swamigal said here on Wednesday that he was going to play a part in the revived talks with religious leaders of both sides on May 14 in Delhi. This move assumes significance in the wake of the Apex Court staying the Allahabad High Court’s judgment of trifurcating the disputed site. Replying to questions on the Supreme Court’s stay on the Allahabad HC judgment the seer said: “I have always said that the Ramjanmabhoomi tangle should not be taken to the court instead it should be settled through talks. As that will only give a lasting solution.”Referring to his failed effort to find a negotiated settlement in 2002 when he held consultations with the members of the All India Muslim Personal Law Board, Sunni Central Waqf Board and Hindu outfits, Swamigal said that Muslim leaders had then agreed to give up the claim on the disputed land. “The talks went up to 12.30 am. They said we don’t want any thing but only the right to worship in the masjid. But when the day broke, some one, went to the court and the outcome of the talks went into a stalemate,” he said. “They are even willing to give up all the disputed sites but they want access to worship. Hundreds of mosques in the country, which are under the Archeological department are inaccessible,” he said. The seer, who is on a religious tour, said, he would leave for Delhi from Salem on Thursday and take part in the talks to be attended by leaders of all the parties involved in the Ramjanmabhoomi issue. Asked if he initiated the talks Jayendra Saraswathi replied in the negative and said, they (Muslim leaders) have invited me. Even earlier it was they who arranged the consultation, he said. Sidesteps Queries Over Politics Initially shying away from questions related to politics, the seer opened up a little later. To a question on which party should win in the State elections, he said, it didn’t make any difference to him, but added “we will support the government that supports us”. He followed this with a statement that temples and religion in general were well taken care of presently. “A lot of religious activities is being conducted in temples in State,” he said.

Supreme Court stays Allahabad High Court verdict on Ayodhya

New Delhi: The Supreme Court on Monday stayed the Allahabad High Court verdict that directed division of 2.77 acres of land of the disputed Ram Janmabhoomi-Babri Masjid site in Ayodhya into three parts among Hindus, Muslims and the Nirmohi Akhara.

A Bench of Justices Aftab Alam and R.M. Lodha, admitting a batch of appeals from both Hindu and Muslim organisations, stayed the September 30, 2010 judgment of the Lucknow Bench of the High Court and directed the parties to maintain the status quo at the site.
Those who filed the appeals included the Sunni Central Wakf Board, U.P.; the Nirmohi Akhara; the All-India Hindu Mahasabha and Bhagwan Shri Ram Virajman.
Senior counsel P.P. Rao, Anoop Chaudhary, Ravi Shankar Prasad, M.N. Krishnamani, Ranjit Kumar, K.N. Bhatt and C.S. Vaidyanathan appeared for various parties.
They unanimously urged the apex court to stay the High Court verdict and restore the status quo order passed by the Supreme Court in 1994 and March 2002 in respect of the activities on the 67.703 acres of government land acquired in January 1993.
This prompted Justice Alam to tell counsel: “At least on one issue, all of you are unanimous. The High Court has granted a new relief, which nobody has asked for it. The High Court has done something on its own. It has to be stayed.”
New dimension
Justice Lodha told counsel: “The High Court's judgment is something strange. A new dimension has been given by the High Court as the decree of partition was not sought by the parties. It was not prayed for by anyone. It has to be stayed. It's a strange order. How can a decree for partition be passed when none of the parties had prayed for it? It's strange. Such kind of decrees cannot be allowed to be in operation. It is a difficult situation now. The position is that the High Court verdict has created a litany of litigation.”
The Bench said the status quo at the disputed site would remain as directed by the 1994 Constitution Bench and the order passed on March 13-14, 2002.
Except puja, no religious activity
The Bench, taking note of the 2002 order, directed that on the 67.703 acres located in various plots detailed in the Schedule to the Acquisition of Certain Area at Ayodhya Act, 1993, “which is vested in the Central government, no religious activity of any kind by anyone be permitted or allowed to take place.” The Bench, while directing the status quo to continue, made it clear that the existing “pujas” in the make-shift Ram Lala temple at the disputed site would go on as usual.
In its appeal, the Wakf Board assailed the High Court judgment. It contended that the suit was decided on the basis of belief/faith of a section of the Hindu community for which there was no admissible evidence. The court had wrongly held that a temple existed at the site in dispute before the construction of the Babri Masjid, while there was no evidence to prove the existence of any such temple or demolition thereof in or around 1528 AD.
It argued that the claims of Muslims, Hindus and the Nirmohi Akhara over the disputed site were mutually exclusive and could not be shared.
The All-India Hindu Mahasabha sought endorsement of the September 30, 2010 minority verdict by Justice Dharam Veer Sharma, who favoured handing over of the entire land to Hindus.
It said: “The judgment by Justice S. U. Khan and Justice Sudhir Agarwal should be set aside to the extent that one-third of the property in dispute has been declared in favour of Muslims and to allot the share to them.”
